The objective of this assignment is to develop training material using the available Training Facilitator’s Guide and deliver the training on Human Rights in Law Enforcement to Tanzania Wildlife Authority.
The SADC Transfrontier Conservation Areas (TFCA) Financing Facility (FF) is a regional financing mechanism established to support conservation, development and management actions in SADC TFCAs. The TFCA FF was established by SADC Secretariat with initial funding from the Federal Ministry for Economic Cooperation and Development in German (BMZ), through KfW, and recently, additional financial commitment from EU-NaturAfrica programme***.*** The TFCA FF is administered by the International Union for Conservation of Nature (IUCN), Eastern and Southern Africa Regional Office (ESARO) as the Project Executing Agency. It is part of the SADC TFCA Programme (2020- 2033), which aims to contribute towards sustainable financing mechanisms for transboundary natural resources management. Implemented through a grant-making mechanism, the initiative aims to invest in tangible measures that strengthen ecological, economic, cultural and institutional connectivity within SADC TFCAs for the management of shared natural resources and sustainable development.
The SADC TFCA FF is aligned with the objectives of the SADC TFCAs Programme and informed by a number for SADC Protocols and Regional Development Strategies. The programme has a focus on improving three main areas:
Improved habitat connectivity, especially for elephants and large carnivores as flagship species (“species” dimension);
Improved management effectiveness of TFCAs and PAs (“habitat” dimension); and
Improved livelihoods for communities affected by human-wildlife co-habitation (“people” dimension)
Description of the Assignment The Consultant’s Task
The objective of this task is to train a maximum of sixty Rangers (60) on mainstreaming Human Rights into Law Enforcement activities.
Task 1: Prepare training material on human rights in law enforcement
i).Familiarization with relevant documentation relating to Law Enforcement and upholding of Human Rights, Inception Calls with TFCA FF Project Management Unit in IUCN, develop the training Programme (Documents to be provided by the TFCA FF and TAWA)
ii).Engage with IUCN, TAWA on the contextual issues relating to Human Rights for the landscape and target group. The information includes but is not limited to:
Wildlife Policies, Code of Conduct for Rangers, standard operational procedures, geographical areas,
Serious incidences of human rights abuses, common cases of human rights abuse in the landscape, and Grievance Mechanism.
Understanding of human rights mainstreaming in conservation law enforcement.
ii).Review of any existing guide on Human Rights in Law Enforcement in Tanzania’s Protected Area Management.
ii).Prepare training material, with reference to any other relevant documentation within the context of human rights in conservation and protected area management, in SADC Region and beyond including the respective project proposal.
The Consultant shall prepare a final work plan for the assignment and any resulting changes to these ToR will be part of the deliveries upon completion of Task 1.
IUCN will provide the Project Proposal that has triggered training on human rights. The proposals provide realistic cases on Law Enforcement activities for identification of potential risks of human rights infringements.
Task 2: Deliver training on Human Rights in law enforcement to Rangers and Game Scouts.
The Consultant shall facilitate training sessions for the Rangers. The Training Course shall be for a period of five (5) days and thereafter deliver the training report to the SADC TFCA FF. The training to be provided under this assignment shall focus on, but not limited to the following aspects:
Ranger’s Code of Conduct, Roles, Responsibilities and Standard Operating procedures, and how they relate to human rights.
Use of practical examples and Scenarios to demonstrate the consequences for neglecting & upholding the Ranger Code of Conduct/Human Rights
Introduction to Human Rights in Law Enforcement.
Explain how human rights are implemented internationally and nationally
Legislative framework for human rights in
Principles of Human Rights applicable to Conservation Law Enforcement
United Nations human rights and the national constitution
Characteristics of Human Rights & Rangers duty
Upholding Human Rights in Conservation context – Reality Based Scenarios (with discussion of rights of Rangers, suspects, communities surrounding PAs, etc.).
Use Of Force Continuum in Law Enforcement in conservation;
Legislation and Ranger mandate on use of force
Principles for Use of Force
Introduction to arrest techniques and procedures
Use Of Force Matrix, Continuum, Lethal tools and Lethal Force that infringes on human rights
Practical scenarios and cases studies on Use Of Force
Managing suspects, detainees, and crowds while upholding human rights
Articulate the need for adherence to the Code of Conduct and law enforcement SOPs with reference to mandate of a Ranger
Please make further reference to the SOPs and Code of Conduct or similar documents for TAWA, Human Rights Agency in Tanzania and the Facilitator’s Guide for the SADC TFCA FF provided.
Task 3: Reporting and recommendation from the Training sessions
The Facilitator shall submit a formal report to the SADC TFCA FF on the training with information such as:
Number of Rangers/Scouts trained (desegregation by Gender)
Areas that revealed interesting issues such as understanding of the topics, competences of the Rangers, challenges, commitment during training, further support required through future trainings, etc.
Based on the training, the Consultant shall identify and document the challenges, gaps related to the thematic areas of focus and make recommendations to be incorporated into the SADC TFCA FF ESMS and for future training.
